    TAKE NOTICE that on 12th day of December, 2008, at the hour of 1:30 p.m., or as soon thereafter as Counsel may be heard, I shall appear before the Honorable Judge Lustfeldt or any judge sitting in his stead in the Kankakee County Courthouse, at 450 East Court Street, Kankakee, Illinois, for the purpose of approving my REPORT, FINDINGS AND RECOMMENDATIONS OF THE CLASS SETTLEMENT ADMINISTRATOR  AND MOTION FOR APPROVAL AND ORDER OF DISBURSEMENT OF SETTLEMENT FUNDS, a copy of which is available for your review both at www.kankakeeclassaction.com and with the Clerk of the Circuit Court of Kankakee County.  Also, I will be seeking approval from Judge Lustfeldt of a payment to you as reflected on the attached calculation sheet.

The filing deadline for submitting a claim in this case was February 14, 2008.  Any claims postmarked by the post office or private courier, or faxed after the deadline are not currently being accepted.  You can check this site in the future to obtain any additional information available concerning when claims will be paid.

The Settlement Order entered in this case required persons to file their claim or to "opt out" of the settlement by February 14, 2008.  On February 28, 2008, the Court conducted a hearing to consider any objections to the Settlement Agreement.  Thereafter, on March 26, 2008, an order approving the settlement and the final judgment was entered.  Under the law, persons affected by the settlement terms had until April 28, 2008, to file an appeal asking the Appellate Court to vacate the Trial Court's order or to modify it in some way.  No appeal was filed and on April 28, 2008, the order became fully enforceable and final.

Consistent with the order, the Settlement Administrator is now reviewing the claims that have been filed.  There are approximately 1,500 such claims.  Each claim must be treated and examined separately and a determination must be made as to how much each claimant is entitled to receive.  Unlike what you may have read in the local paper, this is not a mathematical job.  Each claim needs to be reviewed separately and various factors will effect how much each claimant will receive.  The criteria for evaluating claims in the "outer area" are different than the criteria for evaluating claims in the "core area."  The amount that each claimant will receive will vary from claim to claim and, at this time, the Administrator has no idea how much he will that find any particular claimant should receive.  This process will take a significant period of time to complete.  After the Administrator has made his determination, he will appear in Court with his findings and ask the Court for its approval.  When that approval is given, checks will be mailed to the claimants.

The Settlement Administrator has not been charged with any responsibility for implementing or supervising the installation of municipal water to "core area" residents.  At this time, we have no information concerning that portion of the Settlement.  Any inquires with respect to the installation of water mains, water lines, well capping, or landscape restoration should be directed to Shell's counsel, Mr. John Galvin, (314) 588-7000.  As information becomes available to the Settlement Administrator it will be posted on this web site.  Any other inquires should be made to our toll free number, (866) 661-4637.
